Therefore, and for the purposes provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter, “GDPR”) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and in Law 34/2002, of 11 July, on information society services and electronic commerce (hereinafter, “LSSI”), Taltarni, S.L. informs the user that, as the data controller, it will incorporate the personal data provided by users into an automated file.

The personal data that the user may provide:

  • Name and Surnames

  • Phone number

  • Address and ZIP code

  • Email

  • Location

  • IP address, date and time of access to our services, internet browser used, and data about the device’s operating system. In some cases, filling out the registration form may be mandatory to access and enjoy certain services offered on the website. Likewise, not providing the requested personal data or not accepting this data protection policy may result in the impossibility of subscribing, registering, or participating in any promotions that require personal data.

 

Why and for what purpose do we process your data?

At So-Talented, we process the information provided by interested parties for the following purposes:

  • Managing or contracting some of our services through our web application.

  • Managing the sending of requested information, as well as any other inquiries you may have that are not subject to the conditions of the website or service contract.

  • Managing subscriptions to our blog for the notification of new posts.

  • Developing commercial actions and maintaining and managing the relationship with the user, as well as managing the services offered through the website and information tasks, which may include automated assessments, obtaining profiles, and customer segmentation to personalize the treatment according to their characteristics and needs and improve the online customer experience.

  • Developing promotional activities that may be organized.

  • In some cases, it will be necessary to provide information to authorities or third-party companies for audit purposes, as well as to handle personal data from invoices, contracts, and documents to respond to customer claims or those of public administrations. We inform you that the personal data obtained as a result of your registration as a user will be part of the Registry of Activities and Treatment Operations (RAT), of which Taltarni, S.L. is the owner, and which will be updated periodically in accordance with the provisions of the GDPR.

 

What is the legal basis for processing your data?

The processing of your data may be based on the following legal bases:

  • Consent of the data subject for contracting services through contact forms, requests for information, or subscription to our newsletters (blog subscription).

  • Legitimate interest in processing data from our customers for direct marketing activities and express consent of the data subject for everything related to automated assessments and profiling.

  • Compliance with legal obligations for fraud prevention, communication with public authorities, and third-party claims.

 

How long do we keep your data?

The processing of data for the purposes described will be maintained for the time strictly necessary to fulfill the purpose of its collection (for example, for the duration of the business relationship) and for compliance with the legal obligations arising from data processing.

 

To whom are your data disclosed?

In some cases, only when necessary, So-Talented will provide user data to third parties. However, data will never be sold to third parties. External service providers (e.g., payment providers or delivery companies) with whom So-Talented works may use the data to provide the corresponding services, but they will not use this information for their own purposes or for third-party transfer.

So-Talented headhunter and talentist seeks to ensure the security of personal data when it is sent outside the company and ensures that third-party service providers respect confidentiality and have adequate measures to protect personal data. These third parties are obligated to ensure that the information is processed in accordance with data privacy regulations. In some cases, the law may require the disclosure of personal data to public authorities or other parties, and only the strictly necessary data will be disclosed to comply with these legal obligations.

 

Where are your data stored?

In general, data is stored within the EU. Data sent to third parties outside the EU will be ensured to offer a sufficient level of protection, as they have Binding Corporate Rules (BCR).

What rights do you have and how can you exercise them? You can direct your communications and exercise your rights through a request to the following email: hello@so-talented.io.  In accordance with the GDPR, you can request:

  • Right of access and rectification (Art.15 and 16 GDPR and 13 and 14 LOPDGDD): You have the right to obtain information about the personal data that So-Talented holds about you and the purposes for which it has been used. You also have the right to request the correction of any inaccurate or incomplete personal data at any time.

  • Right to erasure and the right to be forgotten (Art.17 GDPR and 15 LOPDGDD): You have the right to obtain the erasure of your personal data when it is no longer necessary for the purposes for which it was collected or processed in another way. If you have ever given your consent for the processing of personal data, there will always be the possibility of withdrawing that consent for any future processing dependent on it.

  • Right to restriction of processing: You have the right to request the restriction of the processing of your personal data, in which case So-Talented will only keep them for the exercise or defense of claims.

  • Right to object (Art.21 and 22 GDPR and 18 LOPDGDD): You have the right to object to the processing of your data as provided in articles 21 and 22 of the GDPR. So-Talented informs you that even if you object to certain processing, So-Talented may continue the processing if it is based on another legitimate basis, for example, to provide services or to fulfill legal obligations.

  • Right to data portability (Art.20 GDPR and 17 LOPDGDD): In some cases, you can request a copy of personal data in a structured, commonly used, and machine-readable format for transmission to another controller.

  • Right not to be subject to automated individual decisions: You can request that decisions based solely on automated processing, including profiling, that produce legal effects or significantly affect the data subject, not be taken. In some cases, the request may be denied if you request the deletion of data that is necessary to fulfill legal obligations.

Furthermore, if you have any complaints about the data processing, you can file a complaint with the data protection authority.

 

Who is responsible for the accuracy and truthfulness of the provided data?

The user is solely responsible for the accuracy and correctness of the data included, relieving So-Talented of any responsibility in this regard. Users guarantee and respond, in any case, to the accuracy, validity, and authenticity of the personal data provided and undertake to keep them duly updated. The user agrees to provide complete and correct information in the registration or subscription form. So-Talented reserves the right to terminate the services contracted with users if the data provided is false, incomplete, inaccurate, or not updated.

So-Talented is not responsible for the accuracy of information that is not of its own elaboration and from which another source is indicated, so it also assumes no responsibility for any hypothetical damages that may arise from the use of such information.

So-Talented reserves the right to update, modify, or delete the information contained on its websites, even limiting or denying access to such information. So-Talented  is released from liability for any damages or losses that may occur to the user as a result of errors, defects, or omissions in the information provided by So-Talented, provided that it comes from sources outside it.

Likewise, the user certifies that they are over 14 years old and have the necessary legal capacity to provide consent regarding the processing of their personal data.

 

How do we process the personal data of minors?

In principle, our services are not specifically aimed at minors. However, in the event that any of them is aimed at minors under fourteen years of age, in accordance with article 8 of the GDPR and article 7 of Law 3/2018, of December 5 (LOPDGDD), So-Talented will require valid, free, unequivocal, specific, and informed consent from their legal guardians to process the personal data of minors. In this case, the DNI or another form of identification of the person giving consent will be required.

In the case of minors over fourteen years of age, data may be processed with the user’s consent, except in cases where the law requires the assistance of parents or legal guardians.

 

 

What security measures do we apply to protect your personal data?

So-Talented has adopted the legally required levels of security for the protection of personal data and seeks to install other technical means and additional measures within its reach to prevent loss, misuse, alteration, unauthorized access, and theft of personal data provided to So-Talented. 

So-Talented is not responsible for any possible damage or harm that may arise from interferences, omissions, interruptions, computer viruses, telephone breakdowns, or disconnections in the operation of this electronic system, caused by external factors beyond the control of So-Talented; delays or blockages in the use of this electronic system caused by deficiencies or overloads in telephone lines or overloads in the Data Processing Center, in the Internet system, or in other electronic systems, as well as damage that may be caused by third parties through illegitimate intrusions outside the control of So-Talented. However, the user should be aware that security measures on the Internet are not impregnable.

 

How do we use cookies?

The website and social networks of So-Talented use cookies to optimize and personalize your browsing experience. Cookies are physical information files that are stored on the user’s own device. The information collected through cookies serves to facilitate user navigation on the portal and optimize the browsing experience.
